Section 804 - Implementation of Modular Open Systems Approaches and Rights in Interface Software¶

(1) Requirement for Modular Open System Approach¶

Section 2446a of title 10, USC is amended—

(A) in subsection (a), adding: 'Other defense acquisition programs shall also be designed and developed, to the maximum extent practicable, with a modular open system approach to enable incremental development and enhance competition, innovation, and interoperability.'

(B) Key definitions added: - 'modular system interface': a shared boundary between major systems, major system components, or modular systems, defined by various physical, logical, and functional characteristics - 'modular system': a weapon system or weapon system component that can execute independently, communicate across component boundaries, and be separated/reconnected

(2) Rights in Technical Data¶

Government Purpose Rights (GPR) in technical data for modular system interfaces
Applies to interfaces developed at private expense or mixed funding
Interface must be identified in contract solicitation and contract
